Terms of Service - FireKey

Welcome to FireKey (the "Service"), operated by Linkin Black Or White Limited ("Company", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, downloading, installing, or otherwise using FireKey, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Subscription Renewal Agreement. These documents together form the complete agreement between you and the Company regarding the use of the Service.

2. Description of Services

FireKey is an antidetect browser application that provides browser profile management capabilities. Our services include but are not limited to: - Creating and managing multiple browser profiles with isolated environments - Browser fingerprint configuration and management - Proxy integration and management - Team collaboration and member management - Cloud synchronization of profile data - REST API access for automation - Browser extensions management We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Eligibility

You must be at least 18 years of age to use the Service. By using FireKey, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration and Security

To use the Service, you must register an account and provide accurate, complete information. You are responsible for: - Maintaining the confidentiality of your account credentials - All activities that occur under your account - Notifying us immediately of any unauthorized access or use - Ensuring your contact information is current and accurate You may not share your account credentials with any third party. Each account is intended for a single user or entity. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or misused.

5. Prohibited Conduct

You agree NOT to use FireKey to: - Violate any applicable laws, regulations, or third-party rights - Engage in fraud, identity theft, phishing, or other deceptive practices - Distribute malware, viruses, or other harmful code - Infringe on intellectual property rights of any third party - Send spam, unsolicited messages, or engage in abusive marketing - Attempt to reverse engineer, decompile, or disassemble the software - Circumvent or disable any security features of the Service - Interfere with the operation of the Service or other users' access - Resell, sublicense, or redistribute the Service without authorization - Use the Service for any activity that could harm minors We reserve the right to investigate and take appropriate action, including suspension or termination of your account, for any violation of these prohibitions.

6. Fees and Payment

FireKey offers both free and paid subscription plans. For paid subscriptions: - Fees are charged at the beginning of each billing cycle (monthly, quarterly, or annually) - All prices are listed in USD and are exclusive of applicable taxes - We accept the following payment methods: credit/debit cards (Visa, MasterCard, etc.) in USD, WeChat Pay in HKD, and Alipay in HKD - We may adjust pricing with at least 30 days' advance notice; continued use after the effective date constitutes acceptance - Subscriptions do not automatically renew. When your subscription expires, you may manually renew through the billing page in your account settings (see our Subscription Renewal Agreement for details) - Refunds are subject to our Refund Policy Payment processing is handled by third-party payment providers. We do not store your full payment card information on our servers.

7. Intellectual Property

FireKey, including its software, source code, design, logos, trademarks, documentation, and all related content, is the exclusive property of Linkin Black Or White Limited and is protected by international copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your subscription period. You may not: - Copy, modify, or create derivative works of the software - Reverse engineer, decompile, or disassemble any part of the Service - Remove or alter any proprietary notices or labels - Use our trademarks or branding without prior written consent

8. Confidentiality and Feedback

Any non-public information about the Service, including beta features, pricing discussions, and technical documentation marked as confidential, must not be disclosed to third parties. If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, and incorporate such feedback into the Service without any obligation to you.

9. Disclaimer

FireKey is a technology-neutral tool designed for legitimate browser profile management purposes. The Company does not endorse, encourage, or facilitate any illegal activities. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: - The Service will be uninterrupted, error-free, or secure - Any defects will be corrected in a timely manner - The Service will meet your specific requirements - Results obtained from using the Service will be accurate or reliable We shall not be liable for any disruptions caused by force majeure events, including but not limited to natural disasters, wars, government actions, network failures, or cyberattacks.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LINKIN BLACK OR WHITE LIMITED, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR: - Any indirect, incidental, special, consequential, or punitive damages - Any loss of profits, revenue, data, or business opportunities - Any damages arising from your use or inability to use the Service - Any damages exceeding the total fees paid by you in the 12 months preceding the claim These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

11. Termination

Either party may terminate this agreement: - You may cancel your subscription and delete your account at any time through the Service settings - We may suspend or terminate your access immediately if you violate these Terms, engage in prohibited conduct, or fail to pay applicable fees - We may discontinue the Service with 30 days' advance notice Upon termination: - Your right to use the Service ceases immediately - We may delete your account data after a reasonable retention period (see our Account Deletion Agreement) - Sections regarding intellectual property, limitation of liability, governing law, and any accrued obligations shall survive termination

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"). Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force at the time of the arbitration. The seat of arbitration shall be Hong Kong. The language of the arbitration shall be English. Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
